This afternoon the High Court will deliver its judgement on the legality of the Government’s so-called Malaysia solution.

If the decision is in the Government’s favour, the Government will proceed with its arrangements to send 800 asylum seekers who have arrived in Australia by boat to Malaysia for processing.

In return, Australia will over four years accept from Malaysia 4,000 asylum seekers deemed to be refugees.

Despite the generally negative response from activists about the plan, refugees are hoping it does go ahead because it may give them a chance to get to Australia by legitimate means.

However if the decision is against the deal, the Government will find itself somewhat embarrassed and will face a shellacking from the Opposition.

Many feel that the agreement is flawed in the Immigration Minister Chris Bowen has an obligation to ensure that unaccompanied minors that arrive in Australia have their welfare protected.

Sending them to an uncertain future to Malaysia – which is not a signatory to the UNHCR convention on refugees – would essentially amount to dereliction of duty of care.
