Rape and murder in Delhi
A horrible attack could prove a turning point for India’s women
Jan 5th 2013 | from the print edition

WHAT stirred so many Indians to rise up and demonstrate at the murderous gang-rape of a 23-year-old woman on a bus in Delhi on a mid-December evening? Not just the fact of the crime: in India rape has long been depressingly common. Nor just outrage at her fatal internal injuries, inflicted by an iron bar allegedly wielded by the six men charged with the attack: Indian women are far too vulnerable to violent assaults. The reason people took to the streets is that a growing middle class is uniting to make its voice heard. The hope is that their protests will at last mark an advance for India’s beleaguered women .....

India

But can we, in Australia, be complacent?

Well, since you brought up the subject, there is serious talk in India of just that; allowing Indian women their Constitutional Right to possess arms for self protection.

However I was thinking along the lines of some reports placing Australia at the top of, or very near the top the list for the world's highest reported incidents of rape, or as it is usually more euphemistically referred to in Australia: 'sexual assault'.

VICTIMISATION RATE

In 2011, the Australian victimisation rates for selected person offence categories were:

Murder, 1.1 victims per 100,000 persons
Attempted murder, 0.8 victims per 100,000 persons
Manslaughter, 0.1 victims per 100,000 persons
Sexual assault, 76 victims per 100,000 persons
Kidnapping/abduction, 3.0 victims per 100,000 persons

Sexual assault

And?

The rate in Australia seems to be among the highest in the world and higher than in India.

With large differences in the rate of reporting likely between countries.

The rate of reporting is manifestly understated in most countries, Australia included.
However among the OECD countries Australia is tops for rape.

In western countries, as badly as we treat rape victims under our adversarial legal system, is far better than many Muslim countries where the belief is often its the victims fault for encouraging the rapist. Not too sure about Indian culture on this but their reaction seems way over the top, maybe its the media whipping all this up.

The reality of rape its the hardest thing to prove in a mature justice system, in a country like India with religion and cultures dominating the justice systems its anyone's guess on what is really going on .... especially after mixing in the media spin ..... I doubt justice will really happen at all. It struggles here in this area.

India's Justice system is British to the core, 'nuff said.

What is certain is that the perps will be hung and the 17 year old, if sentenced to jail, will be killed in jail.

Otherwise they will be a continuing political embarrassment.

Most brutal among rapists, he won't even have to go to jail

Call it the irony of the legal justice system.

Even as the five men arrested for the gangrape-cum-murder of a 23-year-old paramedical student face the possibility of a death sentence, if proved guilty, one juvenile accused would even escape a jail term.
The juvenile, according to the police, was the most brutal in the sexual assault on the victim.
The boy, who is seventeen-and-a-half-year-old, would not face the trial under the Criminal Procedure Code like his companions.

Though he would face heinous charges of murder, the juvenile would face proceedings under the Juvenile Justice Act that is more of a reformatory process instead of a criminal trial.

AS I said I suspect justice won't happen.
Their system may be based on the British system but their culture(s) are a very dominating factor... the only question in my mind how dominating.

Justice will happen, it's become a political imperative.
They will all die, that's for sure and fairly quickly, people are already asking that the photo of the 17 year old be published so that he can be recognized and killed after he gets out.

That is not justice, you know where you have a proper trial and they are 100 % sure of their guilt and the sentence is not determine by public opinion....... if what you suggests happens that is not justice its a kangaroo court.

The justice system in India works fairly well and the accused will get a fair trial, but if they are guilty they will be found so and will hang.
The 17 year old will be treated according to law and will get 3 years in a reformatory (if the law isn't changed before he comes to trial).

What people are talking of doing will happen after he is released.

The trial will be speedy and already a special court has been set up; this is part of the political imperative.

"You must be realizing, Sir, that justice must not only be being done but that it must be seen to be doing so, especially by the voting persons of the constituencies".

After all the sadness has left us,

After all the talk of reforms have echoed away,

This menace which haunts our society

Will again rear its ugly head.

Our Constitution along with the Arms Act has provisions for every law abiding lady of our country to arm herself.

And if she chooses to do so, and train herself to use her weapon,

Then she will be able to stop such crimes BEFORE they happen.

It will take many many years before our society will change or get deterred by stringent laws,

Till then this technology of the 1800s

The Firearm

Is what will help prevent such crimes.

Apparently there has been a leap in applications for pistol licences from women in Delhi.
Seems that in India women are allowed to protect themselves with the only means that gives them an even or better chance against a rapist.

That's just plain wrong, that ' the justice system works fairly well'. Rape trials take years to get to court, and when they do, and take years to be heard once they start.
